ASA launches three-prong strategy in response to Premarket Approval for SEDASYS®

On May 3, 2013, Ethicon Endo-Surgery, Inc., a subsidiary of Johnson & Johnson (J&J), announced that the Food and Drug Administration (FDA) granted Premarket Approval for the SEDASYS® system, a computer-assisted personalized sedation system. In response, ASA launched a three-prong strategy, including:

• Establishing an Ad Hoc Committee on SEDASYS® , chaired by Rebecca Twersky, M.D., Chair, Section on Professional Standards, to review the FDA's restrictions for use and conditions of approval for the device. The Committee will also determine whether the FDA addressed ASA's concerns and recommendations raised in our previous formal communications to the FDA regarding the device.

• Arranging a meeting with J&J executives to seek information on FDA conditions of approval, particularly around supervision, training and post-market studies.

• Requesting a meeting with the FDA to explore an enhanced role for ASA with the FDA relative to this device and future devices.

Medical direction whistleblower case subject of HHS Office of Inspector General podcast

The U.S. Department of Health and Human Services (HHS) Office of the Inspector General released a podcast interview with an auditor regarding an anesthesia whistleblower case at the University of California Irvine Medical Center. The interview centered on how the auditors determined whether a medically directing anesthesiologist was "immediately available" in instances where cases were reported as personally performed instead of medically directed or medically supervised and findings of insufficient documentation of post-operative care. Congressional Republican leaders decline to offer IPAB appointments
House of Representatives Speaker John Boehner (R-OH) and Senate Minority Leader Mitch McConnell (R-KY) repeated their opposition to the Independent Payment Advisory Board (IPAB) and officially declined to submit names to the President for individuals to serve on IPAB, explaining that since the "law will give IPAB's 15 unelected, unaccountable individuals the ability to deny seniors access to innovative care, we respectfully decline to recommend appointments."

Congressman Harris and HHS Secretary in dispute over IPAB process
In a recent hearing of the House Appropriations Subcommittee on Labor, Health and Human Services, Education and Related Agencies, there was disagreement over IPAB procedures, should board members not be appointed. In a video, Congressman and anesthesiologist Andy P. Harris, M.D. (R-MD) specifically asked HHS Secretary Kathleen Sebelius what would happen if the IPAB is never appointed. The Secretary replied that IPAB simply wouldn't exist. Congressman Harris disagreed and cited the law. Read more and watch the exchange at the hearing.

Beverly Philip, M.D., ASA Committee on Ambulatory Surgical Care member, gave the James H. Nicoll Memorial Lecture at the biennial 10th Congress of the International Association for Ambulatory Surgery (IAAS), held in Budapest, Hungary.
